Any beauty product that is professionally made for use in cleansing, improving the complexion, skin, hair, or teeth falls under purview of cosmetic regulations. Common cosmetics are fragrance, skincare, hair, and manicure products. Compliance adherence from initial cosmetic product development stage to market execution is necessary as it ensures your products will be approved by the regulatory authorities.
In Canada, the cosmetic market value is anticipated to reach around 15.8 billion U.S. dollars in 2021, which is an increase of almost three billion U.S. dollars from the last five years. When it comes to USA, the revenue generated by the Cosmetic Industry is 49.2 billion US dollars. It is the most valuable beauty and personal care market in the world.

Health Canada and FDA require all cosmetic products sold in Canada and USA to be manufactured, packaged, and stored under hygienic conditions. Regulatory authorities are always monitoring misbranded or adulterated commodities, or inappropriate product packaging. Manufacturers or importers are required to carry a safety assessment before marketing their cosmetic products. According to Health Canada, businesses must notify the regulatory authorities that they are selling cosmetics and must provide a list of the product’s ingredients.
Products must adhere to cosmetic labelling regulations i.e. Food and Drugs Act and Cosmetic Regulations in Canada and FD&C Act and FP&L Act in USA.
Regulatory authorities inspect locations where cosmetics are manufactured or stored, and any advertising or labelling material related to a product.
Product safety assessment is encoded in legal or regulatory responsibilities. Manufacturers, importers, distributors or others must conduct a Safety Assessment of their products to ensure only safe products reach consumers.
Health Canada and FDA can issue a warning letter and take legal action against a cosmetic product on the market if they find information showing that the product is adulterated or misbranded.
Information that must appear on the label of a pre-packaged cosmetic include product identification in English (and French in Canada), product's net quantity declaration in metric units, and identity and location of business of the dealer.
