Classes of Natural Health Product (NHP) License Applications

The Natural Health Products Directorate (NHPD) now the Natural and Non-prescription Health Products Directorate (NNHPD) has introduced a system to review Natural Health Product (NHP) applications. The submission of the application is categorized into one of three-class systems (Classes I, II and III). The class categorizes NHPs based on their ingredients level certainty. Each class comes with different review times and different levels of pre-market review.

Class I

Class I is based on a single NHP Monograph. It has the highest level of ingredients certainty with an established efficacy and safety profile for the remedial ingredient. NNHPD performance target is approximately 60 days for an NPN number.

Class II

NHPs in this class are based on 2 or more NHP Monographs. This class possesses a safety and efficacy profile of medium certainty. NNHPD performance target is approximately 90 days for an NPN number.

Class III

At least 1 ingredient in the formula is either not monographed or outside the scope of an NHP Monograph (eg. dosage level, ingredient source or plant part, claims). NNHPD performance target is 210 days for an NPN number after an acknowledgement letter is received.

Distinctions between a NHP and a Drug

In Canada, the regulatory frameworks for Natural Health Products (NHPs) and drugs differ significantly, despite both being products aimed at maintaining or improving health. These differences exist in areas such as product classification, approval process, manufacturing requirements, and post-market surveillance. NHPs: Classified as a subset of drugs under the Natural Health Products Regulations but are treated separately due to their ingredients. NHPs include vitamins, minerals, herbal remedies, homeopathic medicines, probiotics, and traditional medicines. Drugs: include prescription medications, over-the-counter (OTC) drugs, and biologics, regulated under the Food and Drugs Act and the Food and Drug Regulations. Drugs are typically synthetic or chemically derived substances used for the diagnosis, treatment, mitigation, or prevention of diseases. The Natural and Non-prescription Health Products Directorate (NNHPD) oversees their safety, efficacy, and quality. NNHPD focuses on ensuring NHPs meet standards suitable for lower-risk products. Health Canada’s Therapeutic Products Directorate (TPD), which assesses the safety, efficacy, and quality of prescription and non-prescription drugs, ensuring they meet more stringent requirements. Manufacturers or brand owners must apply for a Natural Product Number (NPN), which requires submitting product-specific information such as the ingredients, health claims, and recommended usage. The level of evidence required for approval depends on the risk level of the product, with traditional usage often accepted as proof of efficacy. Before a drug can be sold in Canada, manufacturers must submit a  drug application form such as for OTC drugs, a New Drug Submission (NDS) or an Abbreviated New Drug Submission (ANDS) for generic drugs and obtain a drug identification number (DIN). This requires providing extensive clinical trial data to demonstrate safety and efficacy. New Drugs undergo a rigorous pre-market evaluation, often taking years to approve. However, OTC drugs are a faster approval process taking several months.  NHPs typically contain naturally occurring substances, such as vitamins, minerals, plant extracts, or traditional remedies. They can be synthetic but are naturally derived synthetic duplicate (eg. ascorbic acid).  These ingredients are generally lower in risk and are subject to less rigorous evidence requirements than drugs.  Drug  usually contain synthetic or highly purified chemical compounds. Drug ingredients must be proven safe and effective through substantial scientific and clinical evidence, with higher-risk ingredients requiring stricter evaluations. In Canada, various NHP activities such as importing, manufacturing, packaging and labelling requires a site license whereas with drugs, the same activities but also including testing, distribution, wholesaling requires an establishment license. The health claims made for NHPs are of three types, structure-function, therapeutic and preventative.  They are generally limited to lower-risk, general health maintenance claims, such as promoting overall health or supporting specific bodily functions (e.g., immune support). Claims must be supported by traditional use or limited scientific evidence. Health claims for drugs can be much broader, including specific disease treatment or prevention claims. These claims must be supported by robust scientific data from clinical trials demonstrating efficacy and safety. NHPs are, for the most part, available publicly in various retail outlets and health food stores whereas drugs are available in pharmacies or behind the counter for prescription and some higher risk non-prescription drugs.

Are there any benefits of having an NPN number outside of Canada?

Besides the legal requirement of having an NPN for any natural health product sold in Canada you may be able to leverage the license number in other global jurisdictions. Because of the rigorous approval process to obtain an NPN some countries may accept the NPN as an equivalent to their regulations or the NPN may help the approval process speed.  An international trade certificate (ITC) also helps with exportation of NHPs to other foreign markets.  Quality Smart Solutions is a Health Canada authorized issuer of ITCs. 

What are the requirements if there are changes to your NHP?

If a NPN licensed natural health product has undergone any changes such as license owner name, brand name, ingredient changes, health claim revisions to name a few a post-license notification or amendment must be filed. Some changes such as adding or removing a medicinal ingredient, increasing or decreasing the quantity of a natural health product ingredient, is considered a fundamental change and a new NPN must be obtained.  Any changes must be updated within 60 days of the date of the change.  Health Canada’s processing time is lengthy taking 6 to 12 months.

What else do I need besides an NPN number to sell a natural health product in Canada?

Besides an NPN or HM-DIN license there are two other requirements to sell NHPs in Canada.  The label must meet the natural health products regulations (NHPR) and language laws (French and English).  If the natural health product is manufactured outside Canada, a Health Canada site licensed importer of record is required.  Note that an importer of record role is not a customs broker or carrier. Their role is ensuring the quality of the product by reviewing the testing conducted on each unique lot, verify the expiry date by evaluating the stability study data, investigating quality issues and reporting adverse event reactions, coordinate recalls and report recall investigations to Health Canada to name a importer obligations.
