Under Section 607 of MoCRA, it is mandatory for manufacturers, importers, and distributors of cosmetic products to register their product listings, regardless of whether their facility is located in the U.S. or abroad. If your facility produces or handles cosmetic products for the U.S. market, it must be registered with the FDA. This registration is done using the SPL format through Cosmetic Direct, the FDA’s new electronic submission portal. According to MoCRA’s new requirements, you must submit a cosmetic product listing for each product you produce. This listing must include everything from the ingredients (fragrance or flavor), all variants, and the responsible party to the facility of manufacture and its location.
As a facility owner, operator, or responsible party, you must submit your listings by December 29, 2023. If you’re introducing new cosmetics into the U.S. market, you must list them with the FDA within 120 days of their introduction to commerce.
If there are changes to details of your cosmetic products, you must update them as soon as possible. Otherwise, as a best practice, you should conduct an annual check of your product listings.
